    1. Introduction

    These Terms of Service ("Terms") constitute a legally binding agreement between inithouse.com s.r.o., a limited liability company organized under the laws of the Czech Republic, with its registered office at Příčná 1892/4, Nové Město, 110 00 Praha 1, IČO: 23374390 ("Company", "we", "us"), and you, the user ("User" or "you").

    These Terms govern your access to and use of MagicalSong and its associated AI-powered song creation services (collectively, the "Service").

    2. The Service & AI Nature

    2.1 Functionality

    The Service provides AI-powered tools for creating personalized songs, including generating lyrics, melodies, and full audio tracks based on user-provided descriptions and preferences.

    2.2 AI Disclaimer

    You acknowledge that the Service uses generative AI technologies:

    • Probabilistic Nature: Outputs are generated based on statistics and probability. The Service may produce unexpected or imperfect results.
    • Entertainment Purpose: AI-generated songs are for personal enjoyment and gifting purposes. They do not constitute professional music production.
    • Your Responsibility: You are solely responsible for reviewing and sharing any generated content.

    3. Pricing & Payment

    MagicalSong charges a one-time fee per song generation. Current pricing is displayed on the website at the time of purchase. Payments are processed securely via Stripe. By making a payment, you agree to pay the displayed price for the song generation service.

    4. Eligibility

    You must be at least 18 years old to use the Service, or have parental/guardian consent.

    5. Intellectual Property

    5.1 Our Rights

    inithouse.com s.r.o. owns all rights, title, and interest in the Service, including software, code, and trademarks.

    5.2 Your Content

    You retain ownership of the descriptions you provide ("Input"). We grant you a personal, non-exclusive license to use the songs generated ("Output") for personal and non-commercial purposes. We do not use your data to train our AI models.

    6. Acceptable Use Policy

    You agree NOT to use the Service to:

    • Generate content that is illegal, defamatory, or promotes harm.
    • Create songs intended to bully, harass, or humiliate individuals.
    • Reverse engineer the Service or attempt to extract source code.
    • Use the Service to build a competing product.
    • Abuse the service with automated requests or spam.

    7. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY CZECH LAW:

    7.1 INITHOUSE.COM S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR ANY OUTCOMES RESULTING FROM THE USE OF AI-GENERATED SONGS.

    7.2 THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

    7.3 This limitation does not apply to damages caused by intentional misconduct or gross negligence, or damages to life and health.

    8. Governing Law

    These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts in Prague, Czech Republic.
